Terms and Conditions

Welcome to ClearSpaceWay. These Terms and Conditions govern your use of our seasonal diagnostic and air conditioning system maintenance services. By engaging our services, you agree to comply with and be bound by the following terms.

1. Service Description

ClearSpaceWay provides professional seasonal diagnostic and maintenance services for air conditioning systems. Our services include but are not limited to:

• Comprehensive system diagnostics and performance evaluation
• Seasonal maintenance and tune-ups for optimal efficiency
• Filter replacement and cleaning services
• Refrigerant level checks and adjustments
• Component inspection and preventative maintenance
• Emergency repair services and technical support
• Energy efficiency consultations and recommendations

2. Appointment Scheduling and Cancellation

Clients may schedule appointments through our website, email at [email protected], or by calling +359 88 514 9732. We require at least 24 hours notice for appointment cancellations or rescheduling. Cancellations made with less than 24 hours notice may be subject to a cancellation fee equivalent to 30% of the scheduled service cost.

2.1 Service Availability

Our services are available during regular business hours and by special appointment. Emergency services may be available outside regular hours at premium rates. Service availability is subject to technician scheduling and seasonal demand.

3. Pricing and Payment Terms

All service prices are quoted in Bulgarian Lev (BGN) and are subject to applicable taxes. Payment is due upon completion of services unless otherwise arranged. We accept the following payment methods:

• Cash payments
• Bank transfers
• Credit and debit cards
• Electronic payment systems

For larger projects or commercial clients, payment plans may be arranged in advance. A deposit may be required for extensive repair work or equipment purchases.

4. Warranty and Guarantee

ClearSpaceWay guarantees all workmanship for a period of 90 days from the date of service completion. This warranty covers defects in our service execution but does not cover:

• Normal wear and tear of equipment
• Damage caused by improper use or neglect
• Issues arising from unauthorized modifications
• Manufacturer defects in equipment or parts
• Damage from external factors beyond our control

Parts and equipment installed by ClearSpaceWay are covered by the manufacturer's warranty. We will assist clients in warranty claims when applicable.

5. Client Responsibilities

Clients agree to:

1. Provide accurate information about their air conditioning systems
2. Ensure safe and unobstructed access to all equipment requiring service
3. Disclose any known issues or previous repairs to the system
4. Maintain a safe working environment for our technicians
5. Follow maintenance recommendations provided by our technicians
6. Notify us immediately of any problems following service completion

6. Liability Limitations

While ClearSpaceWay takes every precaution to provide safe and effective services, our liability is limited to the cost of the services provided. We are not responsible for:

• Pre-existing conditions not disclosed during initial assessment
• Consequential damages resulting from system failure
• Delays caused by factors beyond our reasonable control
• Third-party equipment or installation defects

Our maximum liability shall not exceed the total amount paid for the specific service in question.

7. Intellectual Property

All diagnostic reports, maintenance schedules, and technical documentation provided by ClearSpaceWay remain our intellectual property. Clients receive a license to use these materials for their personal or business purposes related to their air conditioning systems but may not reproduce or distribute them without written permission.

8. Privacy and Data Protection

ClearSpaceWay is committed to protecting client privacy. We collect and store personal information necessary for service provision, including contact details, property information, and service history. This information is used solely for service delivery, scheduling, and customer support purposes. We do not sell or share client information with third parties except as required by law.

9. Dispute Resolution

In the event of any dispute arising from these Terms and Conditions or our services, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through mediation before pursuing legal action. All disputes shall be governed by Bulgarian law and subject to the jurisdiction of courts in София (Sofia).

10. Modifications to Terms

ClearSpaceWay reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services following any changes constitutes acceptance of the modified terms. We encourage clients to review these terms periodically.

11. Force Majeure

ClearSpaceWay shall not be liable for any failure or delay in performing services due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather conditions, government actions, labor disputes, or public health emergencies.

12. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

By using ClearSpaceWay's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
